Defining What RCRA Means to Your Business

RCRA forms the basis of a national system of solid waste control, but here the term “solid waste” includes not only solids, but liquids and gases as well; RCRA rules only apply when the solid waste is discarded. Therefore, RCRA does not apply to material that is reclaimed, recycled, or raw material staged or stored for use.

The RCRA framework involves a number of elements-- Subtitle D of the Act is dedicated to non-hazardous solid waste requirements, Subtitle C focuses on hazardous solid waste and Subtitle I was developed to manage underground storage tanks. The framework consists of laws, regulations, policies, and guidance and can be enforced by EPA or by a state, upon authorization (States may become authorized by EPA after demonstrating that their state regulations are equivalent or more stringent than EPA.). EPA or authorized State has the authority to control hazardous waste from generation, to transportation, treatment, storage, and disposal.
